The claim under Section 1983—part of the old Ku Klux Klan Act from the period after the Civil War—was creative, but an uphill battle. Claims under Section 1983 for sexual harassment required concrete proof of adverse job consequences, which the Jones lawyers knew was a challenge at best. The federal claim under Section 1985(3) was almost a throwaway; that statute dealt with private conspiracies to deprive constitutional rights. It was used primarily to deal with conspiracies against African American civil rights workers and other such situations; its application here was dubious.
